If it does not, supplementary measures are needed, and otherwise the transfer must be suspended or ended. The EDPB describes that assessment and the supplementary measures in Recommendations 01/2020.","applied_to_question":null,"matched_terms":[],"articles":[{"article":46,"source_locator":"Art. 46(1) and (2)(c) GDPR","point":"Standard contractual clauses as an appropriate safeguard.","source_title":"GDPR (Regulation (EU) 2016/679)","source_url":"https://eur-lex.europa.eu/eli/reg/2016/679/oj","human_page":"https://www.praxikon.com/en/avg/artikel/46"},{"article":44,"source_locator":"Art. 44 GDPR","point":"The level of protection must not be undermined by a transfer.","source_title":"GDPR (Regulation (EU) 2016/679)","source_url":"https://eur-lex.europa.eu/eli/reg/2016/679/oj","human_page":"https://www.praxikon.com/en/avg/artikel/44"}],"case_law":[{"id":"c-311-18","kind":"judgment","title":"Schrems II","issuer":"CJEU","reference":"C-311/18","ecli":"ECLI:EU:C:2020:559","date":"2020-07-16","status":null,"point":"Operative part: case-by-case assessment, supplementary measures or suspension.","source_url":"https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:62018CJ0311","human_page":null}],"guidance":[{"id":"edpb-rec-01-2020","kind":"guidance","title":"Recommendations 01/2020 on measures that supplement transfer tools to ensure compliance with the EU level of protection of personal data","issuer":"EDPB","reference":"v2.0","ecli":null,"date":"2021-06-18","status":"final","point":"Recommendations on supplementary measures.","source_url":"https://www.edpb.europa.eu/documents/recommendation/recommendations-012020-on-measures-that-supplement-transfer-tools-to_en","human_page":null},{"id":"com-2021-914-scc-transfers","kind":"decision","title":"Standard contractual clauses for transfers to third countries","issuer":"European Commission","reference":"(EU) 2021/914","ecli":null,"date":"2021-06-04","status":null,"point":"The standard contractual clauses of the Commission.","source_url":"https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32021D0914","human_page":null}],"enforcement":[],"open_questions":["To which country do the data go, and has the recipient excluded access by public authorities there?"],"human_page":"https://www.praxikon.com/en/avg/artikel/46","dataset":{"id":"praxikon-gdpr","source":"https://eur-lex.europa.eu/eli/reg/2016/679/oj","known_at":"2026-09-15"},"casus_check":"https://www.praxikon.com/en/casus-check","disclaimer":"General interpretation, not legal advice.
