We train or publish our own AI model. Which GPAI rules apply?

This falls under Article 53: GPAI model providers. That obligation applies today. There is one exception you have to assess yourself.

This could go the other way

  • The open-source exception is limited and retains, among other things, the copyright policy and public training-content summary. Additional duties apply to models with systemic risk.

First step: Maintain GPAI documentation and transparency information.

You describe: A general-purpose AI model (foundation model, LLM) placed on the Union market, including open source. Likely role: provider of a gpai model.

Depends on your situation

These provisions only apply once the stated fact is established. The locator says which provision settles it.

Enforcement is active since 2 August 2026: the AI Office can request documentation, run evaluations and fine up to 3% of global turnover. Models predating 2 August 2025 have until 2 August 2027.

Your first actions

  1. Maintain GPAI documentation and transparency information. Maintain technical documentation, information for downstream providers, a copyright policy and a public summary of training content.
  2. Perform model evaluations and risk mitigation. Evaluate the model including adversarial testing, assess and mitigate systemic risks, report serious incidents and secure the model.

Execution

Implement the GPAI provider obligations for each model

As a GPAI model provider, you organise technical documentation, information for downstream providers and a copyright policy, among other duties. Models with systemic risk have additional obligations. Embed AI helps record the role, applicability, governance and evidence for each model. The source interpretation above is separate from this commercial referral by Praxikon to an affiliated brand.
