The situation in this country
With the AI Market Surveillance and Innovation Promotion Act (KI-MIG), in force since 29 July 2026, Germany runs a hybrid supervision model: the Bundesnetzagentur is the central market surveillance authority, contact point and complaints office, while existing sectoral regulators remain competent in their own domains. The Bundesnetzagentur also operates an AI Service Desk and regulatory sandboxes. No AI Act fines or formal investigations are known in Germany yet.

KI-MIG enters into force
The AI Market Surveillance and Innovation Promotion Act was published on 28 July 2026 (Federal Law Gazette 2026 I No. 233) and entered into force on 29 July 2026, days before most AI Act obligations became applicable on 2 August 2026.

Bundesnetzagentur becomes central market surveillance authority
With the KI-MIG entering into force, the Bundesnetzagentur became the central market surveillance authority, coordinating contact point and complaints office for the AI Act, covering areas such as AI in personnel management, critical infrastructure and education. It also launches an AI Service Desk and regulatory sandboxes for SMEs.

Bundestag adopts AI implementation act
The German Bundestag adopted the KI-MIG in second and third reading. The legislative process included a first reading on 20 March 2026, a hearing on 23 March 2026 and a Bundesrat opinion on 1 April 2026.

Cabinet adopts draft KI-MIG
The Federal Cabinet adopted the government draft of the Act implementing Regulation (EU) 2024/1689 (AI Market Surveillance and Innovation Promotion Act, KI-MIG), following a consultation on the ministerial draft launched on 12 September 2025.
