The situation in this country
Spain established AESIA in 2023 as the EU's first specialised AI supervisor (seat in A Coruña). The formal anchoring of AESIA as market surveillance authority and the full sanctions regime sit in the Organic Law Bill on the good use and governance of AI, which the Council of Ministers sent to Congress on 26 May 2026. Alongside AESIA, the AEPD, the CGPJ and sectoral authorities supervise specific domains. Until the law is adopted the national fining framework is missing; no AI Act fine or formal investigation is known.

AI use and governance bill sent to Congress
On 26 May 2026 the Council of Ministers approved the Organic Law Bill on the good use and governance of artificial intelligence and sent it to Congress (published in the Official Bulletin of the Cortes Generales A-97-1 on 12 June 2026). The bill covers governance and market surveillance with AESIA as central authority, sandboxes, AI use in the public sector and the national sanctions regime under the AI Act. As an organic law it requires an absolute majority.

AESIA statute approved by Royal Decree 729/2023
Royal Decree 729/2023 of 22 August 2023 (Official Gazette 2 September 2023, in force 3 September 2023) approves the statute of AESIA, the Spanish AI supervisory agency seated in A Coruña. AESIA was given supervision, advisory, awareness and training tasks and acts as the hub of Spain's AI Act oversight.
