Post-remote biometric identification system

The residual category: any remote identification that is not real-time. Not prohibited, but high-risk, and subject to its own authorisation regime in law enforcement.

The official source remains authoritative. This is general information about obligations and not legal advice. See this object on the map

What this object links to

Every relation appears below as a path: from the source with its locator, through the conditions and exceptions of the object carrying the relation, to the consequence. A locator belongs to a statement in the data and not to a relation, so the source is the source anchor of the carrying object.

The object is about this role. Undifferentiated: it does not follow that the duty rests on this role.

What this object states

Official fact

Attributable to a named primary source, with a locator. Where they differ, the official source prevails.

  • Article 3(43) defines this as a remote biometric identification system other than a real-time remote biometric identification system.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

  • A residual category is not a free zone. Searching recorded footage for individuals after the fact does not fall under the Article 5 prohibition, but it is high-risk under Annex III, point 1(a) from 2 December 2027. For law enforcement, Article 26(10) applies as well: use requires, in principle, prior authorisation, or authorisation requested without undue delay, from a judicial or independent administrative authority, tied to a specific criminal offence. Organisations that offer "we only look back afterwards" as reassurance are confusing the absence of a prohibition with the absence of obligations.

Recommended step

A practical step we consider appropriate. Not an obligation following from the Regulation.

  • For each search, record who authorised it, which offence or legal basis it rests on, which period and which footage were searched, and what the outcome was.

When this applies

No condition recorded on this object.

When this does not apply

No exception recorded on this object.
