Article 3(42) defines this as a remote biometric identification system whereby the capturing of biometric data, the comparison and the identification all occur without a significant delay, comprising not only instant identification but also limited short delays, in order to avoid circumvention.

Our interpretation
Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.
The reference to limited short delays is deliberate. It shuts down the design in which a buffer of seconds or minutes is added so the operator can claim the system is not real-time. The distinction matters enormously: the use of real-time remote identification in publicly accessible spaces for law enforcement has been prohibited in principle since 2 February 2025 under Article 5(1)(h), with narrow exceptions requiring prior authorisation and a national legal basis.
