  • Article 3(7) defines a distributor as a natural or legal person in the supply chain, other than the provider or the importer, that makes an AI system available on the Union market.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

  • Resellers, systems integrators, marketplaces and staffing firms that ship software along with their service often assume they fall outside the Regulation because they build nothing. The definition is a residual category: if you are neither provider nor importer in the chain, and you make the system available on the Union market, you are a distributor. Note point 10: making available on the market means supply in the course of a commercial activity, whether for payment or free of charge. Passing something on free or offering a trial version is covered too. Put your own name or trademark on it and the role shifts to provider.

Recommended step

  • Map which AI systems your organisation passes on to third parties, including free of charge and as a by-product of a service, and record per system whose name or trademark it carries. Set out in your resale contracts who holds which role, so that it is not disputed later who the provider was.
