  • Article 3(38) defines sensitive operational data as operational data related to activities of prevention, detection, investigation or prosecution of criminal offences, the disclosure of which could jeopardise the integrity of criminal proceedings.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

  • This is the key with which the AI Act softens transparency obligations for law enforcement without removing them. Registration of high-risk systems used by law enforcement authorities takes place in a secure, non-public section of the EU database, and certain information need not be made public where it concerns sensitive operational data. Where it goes wrong: the concept is sometimes stretched to cover anything a public body would rather not share. That does not hold, because the definition is doubly bounded, namely by the criminal law context and by a concrete risk to the integrity of criminal proceedings. Outside that context it is no basis for withholding documentation; commercially confidential information follows a separate route. Equally important: it limits publication, not the access of the competent market surveillance authority.
