Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

This is the key with which the AI Act softens transparency obligations for law enforcement without removing them. Registration of high-risk systems used by law enforcement authorities takes place in a secure, non-public section of the EU database, and certain information need not be made public where it concerns sensitive operational data. Where it goes wrong: the concept is sometimes stretched to cover anything a public body would rather not share. That does not hold, because the definition is doubly bounded, namely by the criminal law context and by a concrete risk to the integrity of criminal proceedings. Outside that context it is no basis for withholding documentation; commercially confidential information follows a separate route. Equally important: it limits publication, not the access of the competent market surveillance authority.
