Law enforcement

The activity, not the authority. Work carried out on behalf of a law enforcement authority is covered as well, including where a private party performs it.

The official source remains authoritative. This is general information about obligations and not legal advice. See this object on the map

What this object links to

Every relation appears below as a path: from the source with its locator, through the conditions and exceptions of the object carrying the relation, to the consequence. A locator belongs to a statement in the data and not to a relation, so the source is the source anchor of the carrying object.

What this object states

Official fact

Attributable to a named primary source, with a locator. Where they differ, the official source prevails.

  • Article 3(46) defines law enforcement as activities carried out by law enforcement authorities or on their behalf for the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including safeguarding against and preventing threats to public security.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

  • The words "on their behalf" are decisive. A vendor, forensic analysis firm or contracted data specialist working for the police operates inside the law enforcement regime, with the corresponding safeguards and registration duties. Conversely, fraud investigation by an insurer, internal integrity investigations and private security are not law enforcement. Those organisations cannot use the exceptions and fall squarely under the ordinary regime, including the prohibition on real-time remote identification as it applies to them.

Recommended step

A practical step we consider appropriate. Not an obligation following from the Regulation.

  • For each deployment, record whether it falls inside or outside law enforcement, naming the commissioning authority and the contractual documents. Put that qualification in the contract so vendor and client apply the same regime.

When this applies

No condition recorded on this object.

When this does not apply

No exception recorded on this object.
