Testing in real-world conditions

Temporarily testing an AI system for its intended purpose outside the lab, in order to gather reliable data and assess conformity. It does not count as placing on the market or putting into service, provided you meet all conditions of Article 57 or 60.

  • Article 3(57) defines testing in real-world conditions as the temporary testing of an AI system for its intended purpose in real-world conditions outside a laboratory or otherwise simulated environment, with a view to gathering reliable and robust data and to assessing and verifying the conformity of the AI system with the requirements of this Regulation; it does not qualify as placing the AI system on the market or putting it into service within the meaning of this Regulation, provided that all the conditions laid down in Article 57 or 60 are fulfilled.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

  • The exception stands or falls on the word provided. If you do not meet all conditions of Article 57 or 60, your test is no longer a test but a putting into service, with all the obligations that entails and an enforcement exposure you did not see coming. In practice this shows up in pilots that quietly continue, tests that are extended to more users or sites, and systems that simply stay in production after the pilot period. Temporary means temporary.

  • For each test, record the start and end dates, the intended purpose being tested, the legal basis in Article 57 or 60, and an explicit decision point at the end: stop, extend under the same conditions, or move to putting into service with the full set of obligations.
