  • Article 50(1) exempts providers of interactive AI systems from the disclosure duty where they are authorised by law to detect, prevent, investigate or prosecute criminal offences, subject to appropriate safeguards for the rights and freedoms of third parties. The Commission guidelines of 20 July 2026 elaborate that exception.

  • The exception is narrow and conditional: it requires a legal basis for the law-enforcement task and appropriate safeguards for third parties. A public task by itself is not enough, and the safeguards are not a footnote but part of the ground you are relying on.
