  • The draft guidelines of 19 May 2026 are a non-binding draft and state in paragraphs 94 to 96 that Article 6(3)(b) requires three cumulative elements: a human activity that has been completed, a result flowing from it, and improvement of that result by the AI system. The system may therefore not replace or autonomously perform the human activity. The draft notes the EU legislature deliberately chose the word improve rather than review, so the system must not be intended to provide a materially different result but to verify or refine the activity, and that any improvement must not change the rights, protection, legal or economic position of the persons affected. As an example that does not qualify, the draft cites a system that checks a human-made decision, plan or construction and provides a substantially different solution. As examples serving an auxiliary improvement function, the draft cites systems that flag errors or contradictions in finalised human work as quality assurance, systems that map conclusions to evidentiary records to strengthen traceability of a decision without substituting human judgment, and systems that convert human-validated content for interoperability or accessibility purposes.

  • This condition is narrower than it sounds. A writing assistant that sharpens the wording of a completed judgment fits; a second-opinion model that redoes the judgment does not, however useful it may be substantively.
