GPAI versus high-risk: the model or the use
The difference
Article 53 is about the model: whoever places a general-purpose AI model on the market has to keep documentation and make information available to downstream providers and to the AI Office. Annex III is about the use: an AI system is high-risk when it is used in one of the listed areas, whatever model sits underneath it.

- Article 53, the model
- The party is a provider of a GPAI model placed on the Union market. For models placed on the market from 2 August 2025, the duties apply from that time. Models placed on the market before 2 August 2025 must comply by 2 August 2027.
- Annex III, the use
- The intended purpose falls within a use case listed in Annex III. Classification follows Article 6(2).
Exceptions
- Article 53, the model
- The open-source exception is limited and retains, among other things, the copyright policy and public training-content summary. Additional duties apply to models with systemic risk.
- Annex III, the use
- A listed Annex III system may fall outside high-risk under the strict conditions in Article 6(3), except where it profiles. The assessment and registration must be documented.

Execution
Get from your supplier what you have to be able to show yourself
