Article 3(9) defines placing on the market as the first making available of an AI system or a general-purpose AI model on the Union market. Point 10 adds that making available on the market means the supply of an AI system or a general-purpose AI model for distribution or use on the Union market in the course of a commercial activity, whether in return for payment or free of charge.

Our interpretation

Our own reading. It can change without the law changing, and it is not the position of a supervisory authority.

The most persistent error is assuming that a sale or a price must be involved. Point 10 explicitly says whether in return for payment or free of charge. A free trial, an openly available model or a no-cost pilot at a customer can amount to placing on the market. The second error is confusing this concept with putting into service. Placing on the market concerns the market; a system you build and use purely internally is not placed on the market, but it is put into service, and that is an independent trigger in its own right.
