What it is about

Adopted on 17 September 2026 as a version for public consultation. The guidelines complement the calculation of fines (Guidelines 04/2022) and give five steps for whether a fine follows: can the infringement be fined, can this party be fined, is there intent or negligence, is the infringement minor under the factors of Art. 83(2), and is a fine effective, proportionate and dissuasive. For a minor infringement there is as a rule no fine; otherwise there is a strong presumption that one follows.

What this means in practice

An error without intent or negligence cannot lead to a fine, but outside minor infringements this version means you should expect a fine. So record which choices you made and why. This is not yet the final text. Comments can be submitted until 13 November 2026.
